CardPouchy Terms of Use

These Terms of Use (“Terms”) are an agreement between you and My Islands LLC (“CardPouchy,” “we,” “us,” or “our”). They govern your use of cardpouchy.com (the “Site”) and our services, including sourcing and selling trading cards to you, proxy selling, valuation, grading submission, vault storage, shipping, and any other services we may offer (the “Services”). By using the Site or Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site or Services.
We may change, suspend, or stop the Site or Services (or any feature) at any time, temporarily or permanently, and we may not be able to give you notice in advance.
1. Eligibility
You must be at least 18 years old and able to enter into a binding contract to use the Site and Services. By using them, you confirm that you meet these requirements.
2. Your Account
Some Services require an account. When you register, you agree to give accurate, current, and complete information and to keep it up to date. You are responsible for keeping your username and password secure and for all activity under your account. Notify us immediately of any unauthorized use of your account or any other security breach.
You may ask us to close your account at any time by contacting us. We may keep certain information after closing your account as described in our Privacy Policy, such as order and payment records required by law.
3. How Our Services Work
- Purchase requests.You may ask us to obtain a card listed on a third-party marketplace or auction site, such as eBay, Fanatics, or Goldin. We decide whether to accept each request. If we accept, we buy the card in our own name, with our own funds, and for our own account. We then sell the card to you at the price stated in your quote. You are buying the card from CardPouchy, not from the original seller.
- We own the card until you pay in full.CardPouchy owns the card from the time we buy it until we receive your full payment, including all fees and charges. Ownership passes to you only when your full payment is received and cleared. Until then, we hold the card, or keep it in a vault, at our discretion.
- Your instructions.You are responsible for the details of your request, including the item link, your maximum price, and any grading or storage choices. We will try to obtain the card within your limits but cannot guarantee that any bid or purchase will succeed.
- Third-party terms.Marketplaces, auction houses, grading companies (such as PSA and Beckett), vault providers, payment processors, and carriers have their own terms, fees, and policies, which apply to our dealings with them. We are not responsible for their acts or omissions, except as these Terms state.
- Valuations are estimates.Any valuation, price estimate, or bidding advice we give is our opinion only. It is not a guarantee of value, grade, or future price.
- Other sales.We may also sell cards from our own inventory. These Terms apply to those sales in the same way.
Proxy selling is different. When you ask us to sell a card that you own, we act as your agent, not as the buyer. Section 8 explains how proxy selling works.
4. Price, Security Deposit, and Payment
- Your quote states the price of the card and any additional charges, such as our service fee, grading, vault, shipping, insurance, and applicable taxes. Prices and fees vary by transaction and are set in each quote. We do not publish a fixed fee schedule.
- Security deposit.Before we accept a purchase request, we may require a security deposit. The deposit secures your request and our service. It is not a payment toward the card price, and we do not use it to pay the original seller. We buy the card with our own funds.
- Full payment.You must pay the full quoted price, less any deposit credit, within 2 calendar days after we notify you that we have acquired the card.
- Settling your deposit.When you make your final payment, you may choose to have your deposit credited against the amount due, so you pay only the balance. Otherwise, we will return your deposit within 2 business days after we receive your full payment.
- If you do not pay.If you do not pay in full on time, we may cancel your purchase request, keep or resell the card, and keep your deposit. You agree that our actual losses in that case, such as resale losses, fees, and time spent, are hard to calculate, and that the deposit is a reasonable estimate of those losses. We may also suspend your account.
- Payment methods.We accept the payment methods shown on the Site or in your quote. You authorize us and our payment processors to charge the payment method you choose.
- Prices are in U.S. dollars unless stated otherwise. Any currency conversion is handled by your payment provider, which may charge its own fees.
5. Unsuccessful Purchases, Cancellations, and Returns
- Unsuccessful purchases.If we do not acquire the card, we will refund your deposit within 2 business days.
- You may cancel a purchase request before we place a bid or complete a purchase, and we will refund your deposit within 2 business days. Once we have bid on or bought the card, you cannot cancel. If you do not pay, Section 4 applies.
- All sales are final, except as stated in Section 9 or required by law. Our service fees for work already performed are non-refundable unless the law requires otherwise.
6. Grading and Vault Storage
- Grading results are decided solely by the grading company. We do not guarantee any grade, and we are not responsible for grading outcomes, delays, or damage caused by the grading company.
- Items stored in a third-party vault (such as PSA Vault or Fanatics Vault) are subject to that provider’s terms, fees, and policies. We are not responsible for the vault provider’s acts or omissions.
- Cards we hold for you.After you pay in full, we may keep your card in our custody or in a vault account in our name until you ask us to ship or transfer it. The card is your property while we hold it. We will take reasonable care of it and keep records showing that it belongs to you. Any storage, transfer, or shipping fees are stated in your quote.
7. Shipping, Risk of Loss, and Customs
- We ship a card only after we receive your full payment, to the address you provide. You are responsible for giving a correct and complete address.
- Delivery times are estimates. We are not responsible for delays caused by carriers, customs, weather, or other events outside our control.
- Risk of loss passes to you when we hand the item to the carrier. We recommend shipping insurance for valuable items. If you decline insurance, you accept the risk of loss or damage in transit.
- Taxes, duties, and fees.You are responsible for all customs duties, tariffs, import taxes, sales and use taxes, VAT, brokerage and clearance fees, and any other taxes, fees, or charges that apply to your order, whether they are collected by us, the carrier, or a government authority. You are also responsible for following the import rules of your country.
- Customs declarations.For international shipments, we always declare the full price of the card on customs forms and all other required shipping documents. We will not under-declare a package’s value, mark it as a gift, or otherwise misstate its contents, even if you ask us to. We do not ship to countries, regions, or persons subject to U.S. sanctions or export restrictions. For high-value international shipments, we may ask you for information needed to complete export filings required by U.S. law.
- Refused or undeliverable packages.If you refuse a package, do not pay import charges, or the package cannot be delivered because of an incorrect address, you are responsible for return shipping and any related costs, and no refund is due. If the package comes back to us, we will reship it after you pay the new shipping costs. If you do not arrange reshipment within 30 days after we notify you, we may sell the card to cover our costs. We will pay you any amount left after deducting our costs, and give you a statement showing the sale price and the costs deducted. We are not responsible if a carrier or customs authority holds, abandons, or destroys a package that you refused or did not clear.
8. Proxy Selling
- When you ask us to sell an item, you confirm that you own it and have the right to sell it.
- We will list and sell the item according to your instructions. We do not guarantee that the item will sell or what price it will reach.
- Within 5 business days after the sale proceeds reach our bank account, we will pay you the proceeds minus our fees and any third-party fees, to the bank account or other payout method you provide.
- If a buyer returns the item, files a dispute, or reverses a payment, we may deduct the related amount from your payouts or ask you to repay it.
9. Authenticity and Condition
We describe each card based on information from the original seller, the marketplace, and any grading company. If you believe a card we sold you is counterfeit, you must notify us within 7 days after the card is delivered to you or transferred to your vault account. This short period lets us pursue a claim against the original seller or marketplace. You must return the card in the same condition you received it, including any grading slab, unopened and unaltered. If a recognized third-party authentication or grading company confirms that the card is counterfeit, we will refund the price you paid for the card. We may decline a refund if you notify us late or the card has been altered or damaged. Apart from this, we do not guarantee a card’s condition or grade beyond its description in your quote, and grading results are decided by the grading company.
10. Prohibited Uses
You agree not to:
- Use the Site or Services for any unlawful purpose, including fraud or money laundering.
- Buy or sell stolen, counterfeit, or illegal items, or items you have no right to sell.
- Give false information or use another person’s account or payment method.
- Scrape, crawl, spider, or use any automated tool to access or copy content from the Site.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Site or its systems.
11. Intellectual Property
All content on the Site, including text, logos, graphics, images, and software (the “Materials”), is owned by CardPouchy or its licensors and is protected by copyright, trademark, and other laws. Images and descriptions of items may belong to third-party marketplaces, sellers, or grading companies. You may view and use the Materials only for your personal, non-commercial use of the Services. You may not copy, reproduce, distribute, modify, or use the Materials for any commercial purpose without our prior written permission.
Third-party trademarks. eBay, Fanatics, Goldin, PSA, Beckett, and other names and logos of marketplaces, auction houses, grading companies, vault providers, and payment providers mentioned on the Site are trademarks of their respective owners. We use them only to identify those companies and their services. CardPouchy is an independent service and is not affiliated with, endorsed by, or sponsored by any of these companies.
12. Disclaimer of Warranties
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. EXCEPT AS STATED IN SECTION 9, CARDPOUCHY DISCLAIMS ALL WARRANTIES, INCLUDING THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We try to keep information on the Site accurate, but we do not guarantee its accuracy or completeness.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CARDPOUCHY AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO AN ORDER WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID US FOR THAT ORDER.
14. Indemnification
You agree to defend, indemnify, and hold harmless CardPouchy and its owners, employees, and agents from any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your violation of any law, or your instructions to us.
15. Suspension and Termination
We may suspend or close your account, or refuse or cancel any order, if we believe you have breached these Terms, acted fraudulently, or created risk for us or others. Sections that by their nature should survive termination, including payment obligations, disclaimers, limitation of liability, and indemnification, will survive.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Before filing a claim, you agree to contact us and try to resolve the dispute informally for at least 30 days. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Alameda County, California, and you consent to the jurisdiction of those courts.
17. Changes to These Terms
We may revise these Terms at any time. When we do, we will change the “Last Updated” date above. If the changes are material, we will post a clear notice on the Site. Your continued use of the Site or Services after the update means you accept the revised Terms. Orders placed before the change are governed by the Terms in effect when the order was placed.
18. General
- Entire agreement.These Terms, our Privacy Policy, and any order-specific quote are the entire agreement between you and CardPouchy about the Site and Services.
- If any part of these Terms is found unenforceable, the rest remains in effect.
- No waiver.Our failure to enforce any right is not a waiver of that right.
- You may not transfer your rights under these Terms without our written consent. We may assign our rights to an affiliate or a successor.
- These Terms are provided in English and Chinese. If the two versions differ, the English version prevails.
